Official Google Blog: When patents attack Android
It isn't really innovation, nor is it 'open' if the tech Google/Android uses is already based on privately owned portfolios of technology. It's just Android wanting a free ride. Overall it doesn't make Google/Android any better, it makes them just as bad, and lacking in innovation. If they needed big brother to step in just because they don't want to pay to play, by the rules without attempting to work out any mutually beneficial agreements. Then that isn't exactly fair to those who own the intellectual property, that's just bullying those who own it into letting Google/Android use it for free. Ultimately the goal of Google appears to be to make it so nobody gets money from anything Google didn't develop/own, and leaves us all at the mercy of pirates, and hackers.
Update: From what I've learned about Android since writing this, it has many proprietary components. It isn't the haven of open source development people make it out to be.
